Action by plaintiff Wilbert William Mix against defendants Farmers Mutual Automobile Insurance Company and Herbert L. Hass
for personal injuries sustained in an accident involving plaintiff's motorcycle and a dump truck driven by Hass. The case
was tried to a jury and a special verdict returned finding negligence on the part of both drivers and apportioning 60 per
cent to defendant Hass and 40 per cent to plaintiff Mix. Plaintiff's motion for judgment on the verdict was denied. Defendants'
motion to dismiss the complaint on the ground that as a matter of law the causal negligence of plaintiff was at least equal
to that of Hass, was granted. From a judgment dismissing the complaint, plaintiff appeals. The facts will be stated in the opinion.
